Approving the request of District Energy St. Paul, Inc. to amend District Heating rates.

WHEREAS, District Energy St. Paul, Inc. filed a notice and official affidavit on September 20, 2010, notifying the City of Saint Paul of a proposed heating rate change; and
WHEREAS, the heating rate change became effective October 1, 2010, until approved or denied by the Saint Paul City Council pursuant to Section 6(e) of the Saint Paul Legislative Code, Appendix F - District Heating Franchise; and
WHEREAS, evidence and recommendations have been presented to the City Council in the form of a City staff report submitted to the City Council on March 30, 2011, in conjunction with a public hearing on this matter; and
WHEREAS, the overall heating system customer rates as proposed by District Energy St. Paul, Inc. represents a 2.7% increase from fiscal year 2010's rates, and thus formal approval by City Council Resolution is required;
NOW, THEREFORE BE IT RESOLVED, that the City Council approves the following heating system customer billing rates increase as proposed by District Energy St Paul, Inc.:
1. The heating demand rate changes from $4.90 to $5.17 per kilowatt per month effective for fiscal year 2011.
2. The heating energy rate changes from $26.86 to $26.59 per megawatt hour effective for fiscal year 2011.
3. The overall heating single rate changes from $0.06145 to $0.06308 per kilowatt hour effective for fiscal year 2011.
