Authorizing the amendment to the Eureka Recycling contract to cover additional labor costs.

WHEREAS, Eureka Recycling is under contract with the City of Saint Paul to provide recycling service for the city through 2016 known as contract number 02-9872 and dated December 7, 1998 with all its previous amendments; and
WHEREAS, item F in the November 23, 2009 contract amendment does provide that the contract may be further amended based upon mutual written agreement; and
WHEREAS, item F further states that the city shall amend the contract should the contractor incur additional labor costs beyond those anticipated in November, 2009; and
WHEREAS, mutual agreement has been reached between the city and the contractor on the impact of labor cost increases to the city service area, now
THEREFORE BE IT RESOLVED, that the proper city officials are hereby authorized and directed, on behalf of the City of Saint Paul, to execute an amendment to agreement number 02-9872 dated December 7, 1998, with all its previous amendments, in order to continue the collection, hauling and processing of recyclables in Saint Paul provided under contract with Eureka Recycling.
