Approving adverse action against the Sidewalk Contractor license held by Gresser Companies, Inc. d/b/a Gresser for the City of Saint Paul.
 
Body
WHEREAS, adverse action was taken against the Sidewalk Contractor license held by Gresser Companies, Inc. d/b/a Gresser (License ID #20020000449) for the City of Saint Paul by Notice of Intent to Suspend License dated December 10, 2010, alleging licensee failed to submit a $5,000.00 Sidewalk Bond for the coverage period of December 31, 2009 through December 31, 2010; and
 
WHEREAS, per Saint Paul Legislative Code ยง310.05 (m) (2), the licensing office also recommended a $500.00 matrix penalty for failure to submit required information in order to maintain the license; and
 
WHEREAS, the licensee did respond to the Notice of Intent to Suspend License on December 16, 2010 to submit the bond but it did not have the principals signature notarized and a power of attorney; and
 
WHEREAS, the Department of Safety and Inspections returned the bond on December 16, 2010, indicating that they needed the bond information completed but it was never returned by the licensee; and
 
WHEREAS, the Notice of Intent to Suspend License stated that if the licensee failed to submit a completed $5,000.00 Sidewalk Bond form by December 20, 2010, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
 
RESOLVED, that the Sidewalk Contractor license held by Gresser Companies, Inc. d/b/a Gresser is hereby suspended and the licensee is ordered to pay a matrix penalty of $500.00 for failure to submit a completed $5,000.00 Sidewalk Bond. Payment of such penalty shall be made within thirty (30) days of the date of the adoption of this resolution.
