WHEREAS, Pursuant to Minnesota Statutes §462.357 and §64.400 of the Legislative Code, Zamzam Inc. duly petitioned to rezone 1555-1571 Maryland Ave E, being legally described as Section 22 Town 29 Range 22 S 173 Ft Of E 84 Ft Of W 264 Ft Of Sw 1/4 Of Se 1/4 (subj To Ave) In Sec 22 Tn 29 Rn 22, PIN 222922430041, and Section 22 Town 29 Range 22 Ex W 264 Ft The S 173 Ft of W 6 Acres of Sw ¼ of Se ¼ (subject To Ave) In Sec 22 Tn 29 Rn 22, PIN 222922430042, from Rezoning from RM1 Low-density Multiple-family Residential to B1Local Business; the petition having been certified by the Department of Planning and Economic Development on July 8, 2010, as having been consented to by at least 67 percent of the owners of the area to be rezoned, and further having been consented to by at least two-thirds of the owners of the property situated within 100 feet of the total contiguous property within one year preceding the date of the petition; and

WHEREAS, the Zoning Committee of the Planning Commission held a public hearing on August 5, 2010, for the purpose of considering the rezoning petition, and pursuant to §107.03 of the Administrative Code, submitted its recommendation to the Planning Commission for approval; and

WHEREAS, the Planning Commission considered the rezoning petition at its meeting held on August 13, 2010, and recommended approval to the City Council; and

WHEREAS, notice of public hearing before the City Council on said rezoning petition was duly published in the official newspaper of the City on July 26, 2010, and notices were duly mailed to each owner of affected property and property situated wholly or partly within 350 feet of...
