Second Making finding on the appealed substantial abatement ordered for 1457 THIRD STREET EAST in Council File RLH RR 23-19.  (Nuisance is abated)

WHEREAS, the City Council adopted RLH RR 23-19 on May 17, 2023 which granted 180 days to repair the structure, correct all of the deficiencies listed in the Order to Abate Nuisance Building and the Code Compliance Report at 1457 Third Street East; and

 

WHEREAS, the Legislative Hearing Officer reviewed this case on November 14, December 5, 2023 to determine if the owner and/or responsible party abated the nuisance conditions and found these conditions were not abated as the Certificate of Code Compliance has not been issued; but will continue to December 20, 2023 for update on issuance of code compliance certificate  and the recommendation is forthcoming;

 

WHEREAS, the Legislative Hearing Officer recommends that if the Code Compliance Certificate is not issued by January 10, 2024, that $2,500 of the $5,000 performance deposit and that for each additional week thereafter that the Code Compliance Certificate is not issued, an additional; $2,500 be forfeited;

 

WHEREAS, the Code Compliance Certificate for the property was issued January 23, 2024; now, therefore, be it

 

RESOLVED, that the Saint Paul City Council adopts the findings and recommendation of the legislative hearing officer that the nuisance is abated and matter resolved and forfeits $2,500 of the $5,000 performance deposit, allowing the remaining $2,500 balance to be returned upon written request to the Department of Safety and Inspections.
