WHEREAS, the Liquor On Sale - 100 seats or less, Liquor On Sale - Sunday, Gambling Location and pending Liquor - Outdoor Service Area (Patio) licenses held by O’Cheeze LLC d/b/a O’Cheeze (License ID# 20210001008) for the premises located at 928 7th Street West Unit 106 in Saint Pau were the subject of a Notice of Intent to Cancel License (“Notice”) dated November 22, 2023; and

WHEREAS, the Notice stated that on June 23, 2023, the Department of Safety and Inspections’ (the “Department”) records indicated that the Licensee’s liquor liability insurance had expired and the licensee had failed to provide proof of the renewed or new liquor liability insurance; and

WHEREAS, on June 23, 2023, the Department’s records indicated that the following licenses expired: Gambling Location, Liquor On Sale - Sunday, and Liquor On Sale - 100 seats or less. The Licensee failed to renew the licenses; and

WHEREAS, on September 27. 2023, the Department emailed the Licensee letting him know that the licenses were delinquent; the Department then emailed the Licensee again on October 6, 2023, stating that licenses were delinquent since the licensee still owed money for the licenses; and

WHEREAS, the Department’s emails stated that if the Licensee failed to take appropriate action in the matter the Department would recommend that adverse action be taken to cancel the licenses; and

WHEREAS, the Notice of Intent to Cancel Licenses (“Notice”) gave the Licensee until December 4, 2023 to either: 1) submit the required information requested by DSI; 2) request a hearing before City Council; 3) request an administrative hearing or 4) cancel the delinquent licenses; and
