Approving adverse action against the Tree Trimmer and Tree Trimmer Vehicle license applications submitted by Arban Inc. d/b/a Arban Outdoor Services (License ID# 20210000564 located at 3718 Sumter Avenue South in Saint Louis Park, MN 55426).

Body

WHEREAS, the Tree Trimmer and Tree Trimmer Vehicle license applications submitted by Arban Inc. d/b/a Arban Outdoor Services (License ID# 20210000564) for the premises located at 3718 Sumter Avenue South in Saint Louis Park were the subject of a Notice of Intent to Deny License (“Notice”) dated October 12, 2023; and   

WHEREAS, the Notice stated that on March 21, 2021, a Department of Safety and Inspections (“DSI”) Inspector left a message for the license applicant (“Applicant”) stating that in order to complete processing the application the licensee needed to submit to a vehicle inspection; and

WHEREAS, on April 13, 2023, the applicant received a second (2nd) message from a DSI Inspector to get the vehicle inspections schedules; and

WHEREAS, on March 2023, 2023, the applicant was called a third (3rd) time and a DSI Inspector left a voicemail message regarding the need to get the vehicle inspected; and

WHEREAS, on October 3, 2023, the applicant was sent a fourth communication (4th), this time an email, from a DSI Inspector. The email was sent to two emails which the Applicant submitted when the Applicant completed the application for the licenses. The email stated that to process the Applicant’s application a vehicle inspection would need to be conducted; and

WHEREAS, the email then gave the applicant until October 17, 2023, to take appropriate action or the Department of Safety and Inspections would recommend adverse action be taken to deny the license applications; and

WHEREAS, on October 3, 2023, Microsoft Outlook emailed the DSI Inspector that had sent out the email to the applicant stating that the email could not be delivered. The email from Microsoft Outlook further stated that neither o...
