Ratifying the assessment for Repair of Sanitary Sewer Line on private property at 944 Cromwell Ave. (File No. SWRP2303A, Assessment No. 233003)

WHEREAS, on August 23, 2023 the City Council adopted RES 23-1214 accepting the Report of Completion for Repair of Sanitary Sewer Line on Private Property (File No. SWRP2302, Assessment No. 233002, "Sanitary Sewer Assessment") that included an assessment requested by the owner of 944 Cromwell Avenue ("944 Cromwell Assessment"); and
WHEREAS, on September 27, 2023 the City Council conducted a public hearing to consider ratification of the Sanitary Sewer Assessment; and
WHEREAS, said owner of 944 Cromwell Avenue requested that the City Council continue the public hearing for the 944 Cromwell Assessment so that the owner's testimony may be included in the record under consideration; and
WHEREAS, the City Council continued the public hearing for the 944 Cromwell Assessment to October 11, 2023 (File No. SWRP2303A, Assessment No. 233003) and ratified the balance of the Sanitary Sewer Assessment; and
WHEREAS, the City Council has considered and found satisfactory the assessment of benefits, costs and expenses for the services charged in the 944 Cromwell Assessment; now, therefore, be it
RESOLVED, that, pursuant to Chapter 429 of Minnesota State Statutes and Minnesota Session Laws 1997, Chapter 231, and Saint Paul Council File No. 00-453, the 944 Cromwell Assessment is hereby in all respects ratified; and be it further
RESOLVED, that said assessment be payable in twenty (20) installments.
