Approving adverse action against the Tobacco Shop license held by River Spirits, LLC d/b/a Liquor Village (License ID# 20120000541) for the premises located at 2289 Ford Parkway. (Licensee will speak to Council on his own behalf)

Body

WHEREAS, the Tobacco Shop license held by River Spirits, LLC d/b/a Liquor Village (License ID 20120000541) for the premises located at 2289 Ford Parkway was the subject of a Notice of Violation and Recommendation For Imposition of $500 Matrix Penalty For Tobacco Youth Compliance Failure herein incorporated as (“Notice”) sent September 15, 2023; and  

WHEREAS, the Notice alleged, that during a Tobacco Compliance Check conducted by the Department of Safety and Inspections on August 21, 2023, an underage person was able to purchase a package of Marlboro Red cigarettes without the clerk asking her age or requesting identification which would have indicated she was underage: and

WHEREAS, the sale of tobacco products to underage persons is a violation of Minnesota Statute §609.685, Subd. 1a and Saint Paul Legislative Code §324.07(i); and

WHEREAS, Saint Paul Legislative Code §324.10 (b)(1) sets forth the penalty of $500 for the first time violation for the sale of tobacco products to a person under twenty-one (21) years of age; and

WHEREAS, the Department of Safety and Inspections is recommending the imposition of a $500 matrix penalty; and

WHEREAS, the Notice gave the licensee until September 25, 2023 to 1) do nothing and a resolution would be submitted to Council to impose the $500 matrix penalty; 2) request a hearing before City Council or 3) request an administrative hearing; and

WHEREAS, on September 18, 2023, the City Attorney’s Office received an email from the licensee admitting to facts of the August 21, 2023 Tobacco Compliance Check but contesting the  $500 matrix penalty and requesting a hearing before City Council; now, therefore, be it
