Approving the application of Ordway Center for a sound level variance in order to present amplified sound on May 30 - June 3, 2023 at Rice Park - 345 Washington St. (Washington St. & 4th St.) and June 3, 2023 at Landmark Plaza.

WHEREAS, Chapter 293 of the Saint Paul Legislative Code was enacted to regulate the subject of noise in the City of Saint Paul; and
WHEREAS, §293.09 provides for the granting of variances from the sound level limitations contained in §293.07, upon a finding by the City Council that full compliance with Chapter 293 would constitute an unreasonable hardship on the applicant, other persons or on the community; and
WHEREAS, Ordway Center, represented by Julia Erickson, Director of Production, who has been designated as the responsible person on the application, has applied for a variance, for 110 dBA at no specified distance, to present amplified sound for the Flint Hills Family Festival at Rice Park - 345 Washington St. (Washington St. & 4th St.) and at Landmark Plaza- 75 5th St W on June 3, 2023.; and
WHEREAS, applicant has requested a variance for the hours of 10:00 a.m. to 1:00 p.m. on Tuesday - Friday, May 30 - June 2, with a pre-event sound check from 9:00 a.m. to 10:00 a.m. for the Festival School Days, 6:00 p.m. to 10:00 p.m., with a pre-event sound check from 5:00 p.m. until 6:00 p.m. on Friday, June 2, and 9:00 a.m. to 4:00 p.m., with a pre-event sound check from 8:00 a.m. to 9:00 a.m. on Saturday, June 3, 2023 for the Flint Hills Family Festival; and
WHEREAS, if applicant is not granted a variance applicant will not be able to present amplified sound at Rice Park - 345 Washington St. (Washington St. & 4th St.) and Landmark Plaza.; and
WHEREAS, the Department of Safety and Inspections has reviewed the application and has made recommendations regarding conditions for the variance. Now, therefore, be it
