Approving the application with no new additional conditions added, per the Deputy Legislative Hearing Officer, for Real Big Huge Brewing Company (License ID# 20210001648), d/b/a Wabasha Brewing Company, to add a Malt Off Sale (Small Brewery- 128 oz) license to the existing Malt Off Sale (Brewery), Malt On Sale (Brewery Taproom), Liquor On-Sale - Sunday, Liquor Outdoor Service Area (Patio) and Entertainment (A) licenses located at 429 Wabasha St S.

WHEREAS, Real Big Huge Brewing Company (License ID# 20210001648), d/b/a Wabasha Brewing Company, located at 429 Wabasha St S, has applied to add a Malt Off Sale (Small Brewery- 128 oz) license to the existing Malt Off Sale (Brewery), Malt On Sale (Brewery Taproom), Liquor On-Sale - Sunday, Liquor Outdoor Service Area (Patio) and Entertainment (A) licenses; and
WHEREAS, a notification regarding the license application was sent from the Department of Safety and Inspections to the affected neighborhood for the period of September 28, 2022, to November 18, 2022; and
WHEREAS, during the notification period, objections were received which triggered the hearing and a hearing was held on December 8, 2022; and
WHEREAS, the objections were related to noise emanating from outdoor entertainment and traffic safety; and
WHEREAS, in response to the concerns raised, the licensee has agreed to work with the city to comply with the necessary requirements to minimize nuisance activities that would disturb the surrounding residential neighborhood; and
WHEREAS, after conducting the hearing and considering the testimonies and evidence, the Deputy Legislative Hearing Officer recommends that the application to add a Malt Off Sale (Small Brewery- 128 oz) license to the existing Malt Off Sale (Brewery), Malt On Sale (Brewery Taproom), Liquor On-Sale - Sunday, Liquor Outdoor Service Area (Patio) and Entertainment (A) licenses, located at 429 Wabasha St S, for Real Big Huge Brewing Company (License ID# 20210001648), d/b/a Wabasha Brewing Company, be approved with no new additional conditions other than the following existing conditions previously agreed to:
1. The outdoor sale/service/consumption of beer shall be limited to the area shown on the approved patio seating plan on file with the Department of Safety and Inspections (DSI).
2. Licensee acknowledges that the licenses issued only permits the sale, service, and or consumption of beer which has been brewed by the licensee on these premises.
3. There shall be no amplification of music, broadcasted events, or entertainment provided outside the building without prior written approval from DSI.
4. Per City of Saint Paul Legislative Code 411.02, the definition of Entertainment A is, "Amplified or nonamplified music and/or singing by performers without limitation as to number, and group singing participated in by patrons of the establishment." (includes karaoke). Entertainment A license does not allow for patron and/or performance dances.
NOW, THEREFORE, BE IT RESOLVED that the Council of the City of Saint Paul hereby approves this license application with the aforementioned agreed-upon conditions and finds that the license conditions are reasonable, and the application is in order and there are no grounds to deny approval of the licenses.
The Conditions Affidavit was signed and submitted on October 18, 2021. (With no changes to conditions, the Conditions Affidavit signed on October 18, 2021 shall remain and continue in full force and effect.)
