Accepting a sidewalk easement from Charter School Property II, Inc. in conjunction with the development of a charter school at 215 University Avenue West.
Body
WHEREAS, Charter School Property II, Inc. ("Property Owner") is constructing a Saint Paul School District charter school (the "Project") within the property located at 215 University Avenue West (the "School Property"); and
WHEREAS, as part of the site plan approval process for the project, the Department of Public Works ("Public Works") of the City of Saint Paul ("City") is requiring a permanent sidewalk easement ("Easement") over a portion of the School Property along its west and north borders in order to close a seven-inch gap between the property line and the building wall; and
WHEREAS, the Property Owner has agreed to provide the Easement and is now requesting that the City accept the Easement, as provided in Exhibit A attached hereto; and
WHEREAS, Public Works and the City Attorney's Office have reviewed and approved the Easement as attached; now, therefore, be it
RESOLVED, that the Council of the City of Saint Paul does hereby accept the Easement in a form and content substantially as set forth in Exhibit A attached hereto, and does authorize the proper city officials to accept an executed original of same and record with the Ramsey County Recorder's Office and/or Registrar of Titles.
