Title

Authorizing the City to enter into a Joint Powers Agreement with the State Department of Public Safety, Bureau of Criminal Apprehension to use systems and tools available over the State’s Criminal Justice Data Communications Network.

 

Body

WHEREAS, pursuant to the provisions of Minnesota Statutes Section 471.59, two or more governmental units, by agreement entered into through action of their governing bodies, are authorized to enter into agreements to exercise jointly or cooperatively governmental powers common to each and to permit one governmental entity to perform services or functions for another governmental unit; and

 

WHEREAS, the City of Saint Paul (“City”) and the State of Minnesota, Department of Public Safety, Bureau of Criminal Apprehension (“BCA”) are governmental units as defined in Minnesota Statutes Section 471.59; and

 

 

WHEREAS, the City of Saint Paul on behalf of its Prosecuting Attorney desires to enter into a Joint Powers Agreement (“JPA”) and an amended Court Data Services Subscriber Agreement with the BCA to use systems and tools available over the State’s Criminal Justice Data Communications Network (“CJDCN”); and 

 

 

WHEREAS, The JPA provides the City with the ability to add, modify and delete connectivity, systems, and tools over the five-year life of the agreement and obligates the City to pay the costs for the network connection; and

 

 

WHEREAS, the City of Saint Paul previously entered into said Joint Powers Agreement and a Court Data Services Subscriber Agreement (RES 17-1453) in October 2017; and

 

 

WHEREAS, the 2017 JPA has expired, the Subscriber Agreement requires amendment, and the City and the BCA desire to execute a new JPA for a term of five-years, and effectuate amendments to the Subscriber Agreement; and  

 

 

WHEREAS, the City Council finds that the JPA and the amended Subscriber Agreement between the City and the BCA related to the use of systems and tools available over the State’s CJDCN relate to the function of government, serves a public purpose, and benefits the community as a whole; and

 

 

WHEREAS, the Mayor of Saint Paul desires to enter into this JPA and Subscriber Agreement to continue the use of the State’s CJDCN in furtherance of the Prosecutorial work of his administration according to the terms and conditions of the attached Agreements; now, therefore, be it

 

 

 

 

RESOLVED, that the Saint Paul City Council hereby: 

 

 

1.                      Approves the Joint Powers Agreement by and between the State of Minnesota acting through its Department of Public Safety, Bureau of Criminal Apprehension, and the City of Saint Paul; and

 

 

2.                      Authorizes the appropriate City Officials, including City Attorney Lyndsey Olson, a Deputy City Attorney, or designee, operating as the Authorized Representative for this transaction, to enter into any contracts or amendments arising out of this JPA and Subscriber Agreement, and also authorizes the appropriate City Officials to execute any subsequent amendments or agreements that may be required by the State of Minnesota to maintain the City’s connection to the systems and tools offered by the State.
