WHEREAS, in the matter of Katherine Gosiger to a Fire Certificate of Occupancy Correction Notice at 258 Seventh Street West, the Legislative Hearing Officer has reviewed the appeal and considered the testimony of City staff and the appellant; and

 

WHEREAS, as of the Legislative Hearing October 18, 2022, the Legislative Hearing Officer recommends that the City Council grant the appeal related to the failing fence and deny the appeal related to the roof/framing orders giving an extension to November 21, 2022 for compliance; and

 

WHEREAS, on October 31, 2022, the City received a letter from Gleeson Architects that Tom Reid's would not be complying with the order; and

 

WHEREAS, given this statement, the Legislative Hearing Officer recommends the Council grant an extension for compliance with the order until such time as the 1) hazardous conditions presented by the adjacent property owner's collapsing wall and fence are abated - noting that this condition exacerbates the already existing hazard presented by the failing roof/framing on this property;

 

WHEREAS, the Legislative Hearing Officer recommends that this extension be granted only if this exterior passage area is secured and accessible only by people involved in the abatement of the hazardous conditions, and not by members of the public, customers or other types of employees at the premise; Now, Therefore, Be It

 

RESOLVED, that the Saint Paul City Council hereby accepts and adopts the Legislative Hearing Officer's recommendation in this matter.
