Waiving the 45-day notice requirement to add a Liquor - Outdoor Service Area (Patio) to existing Licenses to Black Hart of Saint Paul LLC d/b/a The Black Hart of Saint Paul (License ID # 20180001270) for the premises located at 1415 University Avenue.

WHEREAS, Black Hart of Saint Paul LLC d/b/a The Black Hart of Saint Paul (License ID # 20180001270) applied for a Liquor Outdoor Service Area (Patio) for the premises located at 1415 University Avenue in Saint Paul; and
WHEREAS, The Licensee currently holds a Liquor On Sale - 100 seats or less, Liquor On Sale - Sunday, Liquor On Sale - 2 AM Closing, Liquor - Outdoor Service Area (Sidewalk), Entertainment (B), and Gambling Location license and
WHEREAS, licensee was required to seek support from a list of private residences, dwellings and apartment houses within a 300-foot radius of licensee's proposed Liquor Outdoor Service Area (Patio) license at 1415 University Avenue that was provided by the Department of Safety and Inspection by signatures of approval on petitions; and
WHEREAS, licensee sought support from a list of private residences provided by the Department of Safety and Inspection by signatures of approval on petitions; and
WHEREAS, records indicate the licensee had obtained fifteen (15) out of thirty-four (34) possible petition signatures for forty-four percent (44%) in support of adding a Liquor Outdoor Service Area (Patio) license per City of Saint Paul Legislative Code 409.06(g) (2) (c); and
WHEREAS, licensee was unable to obtain the ninety percent (90%) consent or, in the lesser case, sixty percent (60%) or more; and
WHEREAS, the licensee submitted a “good faith” letter outlining his attempt to attain signatures required by the City of Saint Paul from residential property owners; and
WHEREAS, The Department of Safety and Inspections received a letter from Hamline Midway Coalition on September 28, 2022 in support of waiving the 45 day notice requirement and the addition of an Liquor Outdoor Service Area (Patio) license to the existing licenses; and
WHEREAS, in response to the September 29, 2022 notification from the Department of Safety and Inspections regarding the license application, the City received no objections to add the Liquor Outdoor Service Area (Patio) license; and
WHEREAS, the Council finds that issuance of the license will not interfere with the reasonable use and enjoyment of neighboring property and residences and will not bear adversely on the health, safety, morals and general welfare of the community; now, therefore, be it,
RESOLVED, a waiver of the 45-day notice requirement is granted and the Liquor Outdoor Service Area (Patio) License are hereby approved and issued to Black Hart of Saint Paul LLC d/b/a The Black Hart of Saint Paul (License ID # 20180001270) for the premises located at 1415 University Avenue in Saint Paul.
