Title

Approval to apply for Department of Employment and Economic Development (“DEED”) funds in the amount of $500,000 and authorization to enter into an agreement with the State of MN, which includes an indemnification clause, for Phase II of the Chinese Garden project.

 

Body

 

WHEREAS, the City of Saint Paul (“City”) operates Phalen Regional Park as a unit of the regional park system; and

 

WHEREAS, the Metropolitan Council-approved master plan for Phalen Regional Park includes the development of a Chinese Garden at the park; and

 

WHEREAS, the State of Minnesota appropriated $500,000 to the Department of Employment and Economic Development (“DEED”) for a grant to the City for construction of Phase II of the Chinese Garden in Minnesota Laws 2020, Fifth Special Session, Chapter 3, Article 1, Section 21, Subdivision 43; and

 

WHEREAS, the City must apply to DEED to receive the appropriated funds; and

 

WHEREAS, the City has the legal authority to apply for financial assistance, and the institutional, managerial, and financial capability to ensure adequate construction, operation, maintenance and replacement of the proposed project for its design life; and

 

WHEREAS, the City has not violated any Federal, State, or local laws pertaining to fraud, bribery, kickbacks, collusion, conflict of interest or other unlawful or corrupt practice; and

 

WHEREAS, the Saint Paul City Council finds that accepting these grant funds will allow the Department of Parks and Recreation to provide additional cultural and recreational amenities in its park system; now, therefore, be it

 

RESOLVED, that the City of Saint Paul act as the legal sponsor for the project contained in the application to be submitted after approval of this resolution and that the Mayor, Director of Financial Services, Director of Parks and Recreation, and the City Attorney or their designee(s) are hereby authorized to apply to the Department of Employment and Economic Development for funding of this project on behalf of the City of Saint Paul; and, be it further

 

RESOLVED, that upon approval of its application by the State of Minnesota, the City of Saint Paul may enter into an agreement with the State for the above referenced project, and that it will comply with all applicable laws and regulations as stated in all contract agreements; and, be it finally

 

RESOLVED, that the Mayor, Director of Financial Services, Director of Parks and Recreation, and the City Attorney or their designee(s), are hereby authorized to execute such agreements, and amendments thereto, which includes an indemnification clause, as are necessary to implement the project on behalf of the City of Saint Paul.
