Approving the application with conditions, per the Deputy Legislative Hearing Officer, for Jodana Inc (License ID# 20220000729), d/b/a Keenan’s 620 Club / Keenan’s Bar & Grill, located at 620 Seventh Street West.

WHEREAS, Jodana Inc (License ID# 20220000729), d/b/a Keenan’s 620 Club / Keenan’s Bar & Grill, located at 620 Seventh Street West, has applied for a Class N license for Liquor On Sale - 100 seats or less, Liquor On Sale- Sunday, Liquor Outdoor Service Area (Patio), Entertainment (A) and Gambling Location licenses; and
WHEREAS, the application was for a change in corporate name and the addition of Liquor Outdoor Service Area (Patio) and Entertainment (A) licenses, without change in ownership; and
WHEREAS, a notification regarding the license application was sent from the Department of Safety and Inspections to the affected neighborhood for the period of June 6, 2022, to July 22, 2022; and
WHEREAS, during the notification period, objections were received which triggered the hearing and a hearing was held on August 1, 2022; and
WHEREAS, the objections were related to noise emanating from outdoor patio service; and
WHEREAS, in response to the concerns raised, the licensee has agreed to work with the city to comply with the necessary requirements to minimize nuisance activities that would disturb the surrounding residential neighborhood; and
WHEREAS, §409.21 of the Saint Paul Legislative Code permits issuance of a gambling location license to an on-sale licensee to allow lawful gambling conducted by a qualified charitable organization; and
WHEREAS, the license will allow Keenan’s Bar & Grill to conduct lawful gambling as defined by §409.21 (a) (1) of the Saint Paul Legislative Code at 620 Seventh Street West; and
WHEREAS, Czech & Slovak Sokol Minnesota is a nonprofit organization licensed by the state to conduct lawful gambling and is in compliance with Minnesota Statute §349; and
WHEREAS, forty-four (44) residential properties are within a 300-foot radius of licensee’s proposed Liquor - Outdoor Service Area (Patio) license, and licensee must seek consent of neighboring residential properties and obtain ninety percent (90%) approval or, in the lesser case, sixty percent (60%) or more approval; and
WHEREAS, licensee sought support from a list of private residences provided by the Department of Safety and Inspection by signatures of approval on petitions; and
WHEREAS, licensee was unable to obtain the ninety percent (90%) consent or, in the lesser case, sixty percent (60%) or more; and
WHEREAS, licensee, per City of Saint Paul Legislative Code 409.06(g) (2) (c), was able to receive positive consent from nineteen (19) residential owners or forth-three percent (43%) of support, including receiving support from the West 7th / Forth Road Federation District Council as of August 30, 2022; and
WHEREAS, the Council finds that these efforts constitute a good-faith effort to fulfill all petition requirements, and that the results of the attempts to obtain signatures showed a generally favorable disposition from the surrounding community toward the proposed licensed activity; and
WHEREAS, the Council finds that issuance of the license will not interfere with the reasonable use and enjoyment of neighboring property and residences and will not bear adversely on the health, safety, morals, and general welfare of the community; and
WHEREAS, after conducting the hearing and considering the testimonies and evidence, the Deputy Legislative Hearing Officer recommends that the application for Liquor On Sale - 100 seats or less, Liquor On Sale- Sunday, Liquor- Outdoor Service Area (Patio), Entertainment (A) and Gambling Location licenses, located at 620 Seventh Street West, for Jodana Inc (License ID# 20220000729), d/b/a Keenan’s 620 Club / Keenan’s Bar & Grill, be approved with the following conditions:
1. Per City of Saint Paul Legislative Code 411.02, the definition of Entertainment A is, "Amplified or nonamplified music and/or singing by performers without limitation as to number, and group singing participated in by patrons of the establishment." (includes karaoke). Entertainment A license does not allow for patron and/or performance dances.
2. No entertainment is allowed outdoors unless prior written approval is obtained from the Department of Safety and Inspections (OSI).
NOW, THEREFORE, BE IT RESOLVED that the Council of the City of Saint Paul hereby approves this license application with the aforementioned agreed-upon conditions and finds that the license conditions are reasonable, and the application is in order and there are no grounds to deny approval of the licenses.
The Conditions Affidavit was signed and submitted on August 17, 2022. A statement documenting a good faith effort to obtain support dated August 30, 2022, was submitted.
