Approving the application with no new conditions, per the Deputy Legislative Hearing Officer, for Taste of Rondo LLC (License ID #20190000107), d/b/a Taste of Rondo Restaurant, to add a Gambling Location license to its existing Liquor On Sale - 100 seats or less, Liquor On Sale - Sunday, and Entertainment (A) licenses, located 976 Concordia Avenue.

WHEREAS, the Taste of Rondo LLC (License ID #20190000107), d/b/a Taste of Rondo Restaurant, has applied for a Class N license to add Gambling Location license to its existing Liquor On Sale - 100 seats or less, Liquor On Sale - Sunday, and Entertainment (A) licenses, and
WHEREAS, §409.21 of the Saint Paul Legislative Code permits issuance of a gambling location license to an on-sale licensee to allow lawful gambling conducted by a qualified charitable organization; and
WHEREAS, the license will allow Taste of Rondo Restaurant to conduct lawful gambling as defined by §409.21 (a) (1) of the Saint Paul Legislative Code at 976 Concordia Avenue; and
WHEREAS, the Aliveness Project is a nonprofit organization licensed by the state to conduct lawful gambling and is in compliance with Minnesota Statute §349; and
WHEREAS, a notification regarding the license application was sent from the Department of Safety and Inspections to the affected neighborhood for the period of April 19, 2022 to June 3, 2022; and
WHEREAS, during the notification period, an objection was received which triggered a hearing and a hearing was held on June 23, 2022; and
WHEREAS, the objection was related to “gambling stimuli [creating] curfew, noisy, obnoxious visitors, etc.”; and
WHEREAS, after conducting the hearing and considering the testimonies and evidence, the Deputy Legislative Hearing Officer recommends that the application for Taste of Rondo LLC (License ID #20190000107), d/b/a Taste of Rondo Restaurant, to add a Gambling Location license to its existing Liquor On Sale - 100 seats or less, Liquor On Sale - Sunday, and Entertainment (A) licenses, located at 976 Concordia Avenue be approved with no new conditions added to the existing conditions:
1. Licensee agrees to operate the establishment in compliance with Section 409.02 of the City of Saint Paul Legislative Code as a "Restaurant" and acknowledges having received a copy of Section 409.02. Requirements under this section include that the establishment offer full menu service up until one (1) hour prior to closing, actively promotes food sales, and maintains a kitchen staffed with clearly identifiable personnel during all hours of full menu service.
2. Licensee agrees to close the establishment at 12:00 a.m. midnight. All patrons/customers/members of the establishment shall vacate the premises by 12:30 a.m. each day of the week as per Section 409.02 of the City of Saint Paul Legislative Code.
3. The sale, service, display and/or consumption of alcohol shall be restricted to the licensed premises area as per the approved plan on-file with the Department of Safety and Inspections (DSI). Licensee acknowledges the approved liquor service area shall be restricted to the interior of the first floor (i.e., main level) of the building. No liquor sales, service, display and/or consumption is permitted in the basement of the building without prior written approval from DSI.
4. No sales, service, display, and/or consumption of alcohol is allowed outdoors without prior written approval and additional licensing from DSI.
5. Per City of Saint Paul Legislative Code 411.02, the definition of Entertainment A is, "Amplified or nonamplified music and/or singing by performers without limitation as to number, and group singing participated in by patrons of the establishment." (includes karaoke). Entertainment A license does not allow for patron and/or performance dances.
THEREFORE, BE IT RESOLVED that the Council of the City of Saint Paul hereby approves this license application with no new conditions added to the existing conditions.
