Title

Authorizing the Department of Public Works to enter into a statewide mutual aid agreement jointly with other government municipalities and entities.

 

Body

 

WHEREAS, pursuant to Minnesota Statues, Section 471.59, governmental units may jointly or cooperatively exercise any power common to the contracting parties or any similar powers by agreement entered into through action of their governing bodies; and

 

WHEREAS, this statewide mutual aid agreement provides a process for units of government to share public works personnel and equipment with other agencies within the State of Minnesota; and

 

WHEREAS, the public works personnel and equipment can be loaned in response to emergencies or normal operational needs; and

 

WHEREAS, if the City of Saint Paul were to accept aid from a member agency there may be reimbursement costs related to that aid, per the agreement; and

 

WHEREAS, the agreement also contains a defense and indemnification provision, whereby the requesting party agrees to defend and indemnify the sending party against any claims brought or actions filed against a sending party or any officers,

employees, or volunteers of a sending party for injury or death to any third person or persons or damage to the property of third persons arising out of the performance and provision of Public Works assistance pursuant to the agreement; and

 

WHEREAS, the City of Saint Paul desires to enter said agreement; now, therefore, be it

 

RESOLVED that the City Council of  Saint Paul, Minnesota hereby authorizes the Mayor and proper City Officials to enter into this Public Works Joint Powers Mutual Aid Agreement, and

 

BE IT FURTHER RESOLVED that the Director of Public Works, the Public Works Operations Manager, or their designee, are designated as the “Requesting Official” and the “Sending Official” for the Public Works Joint Powers Mutual Aid Agreement.
