Amending Section 409.07 of the Legislative Code to allow Sunday sales in micro-distilleries.

SECTION 1

WHEREAS, microdistilleries are increasing in popularity and as a destination for residents and tourists, they bring vitality to our neighborhoods and entertainment districts; and

WHEREAS, brewer taprooms and all other eligible on-sale liquor establishments are allowed to sell their on-sale products on Sundays; and

WHEREAS, allowing Sunday sales at microdistilleries would allow them to expand their service hours, increase their viability and meet the needs of more visitors; and

WHEREAS, the city would like to support business growth and success by allowing Sunday sales at distilleries; and

WHEREAS, Minnesota State Statute Section 340A.22 titled Microdistilleries allows a municipality to authorize a cocktail room to be open and conduct on-sale business on Sundays; and

WHEREAS, the City of Saint Paul wishes to add microdistilleries to the list of licensed businesses which can conduct on-sale business on Sunday; now, therefore be it

RESOLVED, that the Council of the City of Saint Paul does hereby ordain:

SECTION 2

Chapter 409.07 of the Saint Paul Legislative Code is hereby amended as follows:

Sec. 409.07. Hours of sale; Sunday sales, etc.

(a)                     On-sale hours of sale.

(1)                     Intoxicating liquor on-sale. No sale of intoxicating liquor shall be made after 1:00 a.m. on Sunday nor until 8:00 a.m. on Monday. No on-sale shall be made between the hours of 1:00 a.m. and 8:00 a.m. on any weekday.

(2)                     Sales after 1:00 a.m. Establishments holding only on-sale wine and/or on-sale malt liquor licenses shall not be eligible to sell wine and/or malt liquor after 1:00 a.m. An establishment holding on-sale licenses other than on-sale wine and/or on-sale malt which has received a permit from the state which authorizes sale of intoxicating liquor or three and two-tenths (3.2) pe...
