Title

Accepting a dedication of easement for public sewer purposes and a temporary construction easement from Lakewood Group Three, LLC for the improvement and expansion of existing sewer facilities and pumping station; and authorizing compensation for the easements to Lakewood Group Three, LLC.

Body

WHEREAS, in 1971 the City of Saint Paul, Department of Public Works (“City”), in the area bounded by Hamline Avenue, Pascal Street, Wynne Avenue and Jessamine Avenue, installed sewer facilities and a pumping station to benefit the surrounding properties; and

WHEREAS, said sewer facilities and pumping station are now in need of improvement and expansion; and

WHEREAS, the City hired a private real estate consultant to assist with the acquisition of a permanent easement for public sewer purposes and a temporary construction easement within a parcel of land in the above-mentioned area located at 1395 Jessamine Avenue West and owned by Lakewood Group, LLC (“Property Owner”); and

WHEREAS, said consultant secured appraised values of the proposed easements, submitted offers and entered into negotiations with the Property Owner, and recommended final compensation amounts of Twenty-Four Thousand One Hundred Forty-Eight and 80/100 Dollars ($24,148.80) for the permanent easement and Fifteen Thousand Eight Hundred Fifty-One and 20/100 Dollars ($15,851.20) for the temporary construction easement; and

WHEREAS, staff from the Department of Public Works Sewer Division and the Office of Financial Services Real Estate Section have reviewed the work of said consultant and agree that the recommended compensation amounts are fair and reasonable, and thus recommend approval of same by the City Council; now, therefore, be it

RESOLVED, that the Mayor and Council of the City of Saint Paul do hereby approve the recommended easement compensation amounts and accept the permanent easement, as set forth in Exhibit A1 attached hereto, and the temporary construction easement, as set...
