Authorizing the execution of a drainage and utility easement along Mississippi River Boulevard.

WHEREAS, the Mississippi River Vista plat (“Plat”) was approved with the adoption of CF #PH 20-74; and
WHEREAS, said Plat contained a drainage and utility easement over the northern portion of the platted land in the area of a natural ravine; and
WHEREAS, the Plat also dedicated parkway right of way as Mississippi River Boulevard to fulfill the parkland dedication requirements of the subdivision regulations; and
WHEREAS, the developers of the Plat wish to construct stormwater improvements within the ravine in the dedicated right of way; and
WHEREAS, the ravine receives stormwater from the development, from the abutting private property to the north of the development, and from the right of way; and
WHEREAS, it is necessary to establish operations and maintenance obligations for the stormwater improvements; and
WHEREAS, said obligations will principally fall on the developer, and post-development, the homeowners association of the development; and
WHEREAS, a drainage and utility easement has been drafted to document the rights and responsibilities of the parties contributing stormwater to the ravine; now, therefore, be it
RESOLVED, that the proper city officials are hereby authorized and directed to execute a drainage and utility easement in a form and content substantially as set forth in Exhibit A attached hereto.
