Title

Approving the release of an easement for slopes, cuts and fill over Lots 25, 26, 27, 28, 29, 30, Block 6, Summit Park Addition.

 

Body

WHEREAS, in 1923, as part of the grading and paving of the alley in Block 6, Summit Park Addition to St. Paul, Ramsey County, Minnesota, the City of Saint Paul ("City") condemned easements for slopes, cuts and fills on private properties within Block 6. The Easement was approved by Final Order in Council File No. 46228 on June 8, 1923 and was recorded in Ramsey County as Document Number 642832 on September 13,1923, copies of which are attached hereto; and

 

WHEREAS, the Easement encumbers the property at 695 Grand Avenue, which includes Lots 25, 26, 27, 28, 29, 30, Block 6, Summit Park Addition (the "Property") and is owned by St. Albans Crossing II ("Owner"); and

 

WHEREAS, on behalf of the Owner, Ari Parritz of Reuter Walton Development has requested the release of the portion of the Easement encumbering the Property; now, therefore, be it

 

RESOLVED, that with the Certificate of Intended Non-Use, filed voluntarily on behalf of the City's Department of Public Works, the City, for itself and on behalf of said department, hereby waives, releases and terminates the Easement rights encumbering the Property; and be it further

 

RESOLVED, that upon passage of this resolution and the City's receipt from the Owner of a $300.00 administrative processing fee, the proper City officials are hereby authorized and directed to record a copy of this resolution in the office of the Ramsey County Recorder and/or Registrar of Titles, and that the Office of Financial Services Real Estate Section shall maintain on file a copy of the Certificate of Intended Non-Use referenced in this resolution; and be it finally

 

RESOLVED, that all other terms and conditions of Ramsey County Document Number 642832 shall remain in full force and effect and be fully incorporated into this resolution.
