Authorizing the Police Department to partner with the Minnesota National Guard to donate its expired body armor and helmets (hereinafter referred to as “protective gear”).

WHEREAS, the Saint Paul Police Department is seeking to partner with Minnesota National Guard who is working in cooperation with United States European Command conducting a nationwide drive seeking surplus, donated or protective gear that can be provided to the defenders of the ongoing war in the Ukraine; and
WHEREAS, the Saint Paul Police Department has collected approximately 100 vests and 10 helmets belonging to the City to donate free of charge for this effort; and
WHEREAS, the Minnesota National Guard and United States European Command accepts the donated vests and helmets “as is” with all of their faults, and without any warranty or guarantee from the SPPD, the City of Saint Paul, its employees, agents, representatives or assigns that these vests and helmets are suitable for their intended use; and
WHEREAS, the Minnesota National guard and United States European Command by accepting the donated vests and helmets, hereby waives all claims, liability, and damages against the SPPD, the City of Saint Paul, its employees, agents, representatives or assigns attributable to its possession, use or otherwise of the donated vests and helmets; and
WHEREAS, the Minnesota National Guard will handle requests for protective gear from other agencies and coordinate delivery; and
THEREFORE, BE IT RESOLVED, that the council approves the Saint Paul Police Department donation of its protective gear to the Minnesota National Guard and United States European Command.
