Approving the adverse action against the Auto Repair license held by Castillo Auto Repair LLC d/b/a Castillo Auto Repair (License ID# 20200001910) for the premises located at 744 3rd Street East.
Body
WHEREAS, the Auto Repair license held by Castillo Auto LLC d/b/a Castillo Auto Repair (License ID# 20200001910) for the premises located at 744 3rd Street East in Saint Paul were the subject of a Notice of Violation dated February 2, 2022; and
WHEREAS, the Notice stated that during a complaint-based inspection of the licensed premises on December 1, 2021 an inspector from the Department of Safety and Inspections (DSI) observed and documented seven (7) license condition violations; and
WHEREAS, On January 7, 2022, the Department of Safety and Inspections sent the licensee a Correction Notice detailing these violations and given until January 17, 2022, to bring the licensed premises into compliance with his license conditions; and
WHEREAS, On January 21, 2022, the inspector returned to the licensed premises for a re-inspection and observed and documented with photographs three (3) license condition violations; and
WHEREAS, this is the first (1st) violation within twelve (12) months, pursuant to Saint Paul Legislative Code § 310.05 (m) (1), the licensing office recommended a $500.00 matrix penalty; and
WHEREAS, the licensee did not respond to the Notice of Violation to either pay the $500.00 matrix penalty or request a public or administrative hearing; and
WHEREAS, the Notice of Violation stated that if the licensee failed to pay the $500.00 matrix penalty or request a public or administrative hearing by February 16, 2022, that the matter would be placed on the next available consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, the Auto Repair license held by Castillo Auto LLC d/b/a Castillo Auto Repair (License ID# 20200001910) for the premises located at 744 3rd Street East in Saint Paul is hereby ordered to pay a matrix penalty of $500.00 for three (3) license condition violations observed and documented by a DSI Inspector during a complaint-based inspection of the licensed premises on December 1, 2021.
Payment of such penalties shall be made within thirty (30) days of the date of the adoption of this resolution
