Pertaining to a Thirty-Fifth Rider to Agreement with the City of Little Canada to provide for construction of a hard surface trail connection from the dead end of Woodlynn Avenue to an existing trail within Board-owned right-of-way.

WHEREAS, the Board of Water Commissioners of the City of Saint Paul (“Board”) is owner of a 110 foot wide easement right-of-way located in the NW quarter (NW ¼) of the NW quarter (NW ¼) of Section 6, Township 29 North, Range 22 West, in the city of Little Canada, Ramsey County, (the “Premises”); and
WHEREAS, the City of Little Canada entered into an Agreement with the Board dated July 13, 1966, for the purposes of locating certain public works within the Board’s rights-of-way; and
WHEREAS, the City of Little Canada desires to construct and maintain a hard surface trail connection from the dead end of Woodlynn Avenue to the existing hard surface trail within the Board’s right-of-way; and
WHEREAS, staff has prepared a Thirty-Fifth Rider to that Agreement of July 13, 1966 setting forth the conditions of construction and access over the Premises and which protects the Board’s rights, interests, and facilities; and
WHEREAS, the Assistant City Attorney has reviewed and approved said Rider as to form; now, therefore, be it
RESOLVED, that the Thirty-Fifth Rider to Agreement with the City of Little Canada is hereby approved in substantially the form submitted and that the proper officers of the Board are hereby authorized and directed to execute said Rider on behalf of the Board.
