Title

Authorizing the conveyance of six City owned properties to the St. Paul Public School District.

 

Body

WHEREAS, Chapter 705-S.F. No. 2062 of the 1965 Minnesota Laws (“Chapter 705”), attached hereto, converted the Special School District of the City of Saint Paul (“City”) to the Independent School District No. 625 (“School District”); and Section 1, Subd. 18 of Chapter 705 required the transfer of all City-owned property used for school purposes to the School District; and

 

WHEREAS, recent title research by the School District has identified 60 properties ("School Properties") that have long been under the jurisdiction of the School District but whose title has remained in the City’s name; and

 

WHEREAS, the School District is now requesting that the City convey the School Properties to the School District based on the belief that the School Properties were always intended to be transferred to the School District with other property transfers when the School District was established in 1965; and

 

WHEREAS, the School District has provided title evidence and maps of the first six School Properties (“First Properties”) requested to be conveyed, consisting of the following school sites:

 

1.                     Adams Spanish Immersion School

2.                     Highland Park High School and Middle School

3.                     Horace Mann Elementary

4.                     Humboldt Secondary School and Open World

5.                     Phalen Lake Hmong Studies Magnet

6.                     former Edgcumbe School property; and

 

WHEREAS, the City has verified its title to the First Properties and concurs with the School District that title should have been conveyed with other property transfers when the School District was established; now, therefore, be it

 

RESOLVED, that the City Council hereby authorizes and directs the proper city officials to convey by quit claim deed the First Properties to the School District, and to execute any and all documents necessary to effectuate the property transfer.
