WHEREAS, the Liquor On-Sale 100 Seats or less, Liquor On-Sale Sunday, and Gambling location license held by Anvil Properties Inc. d/b/a The Foundry Pub (License ID #20040004132) for the premises located at 1201 Jackson Street in Saint Paul was the subject of a Notice of Violation and Request for Upward Departure (“Notice”) sent November 10, 2021 (herein incorporated as Exhibit 1); and

WHEREAS, the Notice stated that based on the following violations that occurred on April 24, 2021:
? Complaints of excessive noise while patrons are leaving the bar after 10pm
? The assault of a customer by staff which included striking a patron with a bottle
? Denying Saint Paul Police officers entry into the bar
? Problems of trash and litter, loitering and drinking in the parking lot

WHEREAS, due to the number of violations the City of Saint Paul Department of Safety and Inspections requested an upward departure from the first to the second box on the penalty matrix as laid out in Saint Paul Legislative Code § 310.05(m)(2) which is a $1,000.00 fine; and

Per Saint Paul Legislative Code § 310.06, the Department of Safety and Inspections also recommended that conditions be added to the Licenses held by Licensee; and

WHEREAS, the License conditions recommended by the Department were:
