Approving the application with conditions, per the Deputy Legislative Hearing Officer, for Kitty's Corner 2 Inc. (License ID# 20160000243), d/b/a Kitty’s Corner 2, to add a Malt Off Sale license to the existing Gas Station and Cigarette/Tobacco licenses, located at 1530 Sherwood Avenue.

WHEREAS, Kitty's Corner 2 Inc. (License ID# 20160000243), d/b/a Kitty’s Corner 2, located at 754 Randolph Avenue, located at 1530 Sherwood Avenue, has applied for Class N licenses to add a Malt Off Sale license to the existing Gas Station and Cigarette/Tobacco licenses; and
WHEREAS, an objection to the requested license was received within the notification period of September 29, 2021 to November 19, 2021, and a hearing was held on December 16, 2021; and
WHEREAS, the objection was related to concerns about the business’ safety plan and frequency of crime in the neighborhood; and
WHEREAS, in response to the concerns raised, the licensee has agreed to work with the City to comply with the necessary requirements to minimize nuisance activities that would disturb the surrounding residential neighborhood; and
WHEREAS, after conducting the hearing and considering the testimony and evidence, the Deputy Legislative Hearing Officer recommends that the application for Kitty's Corner 2 Inc. (License ID# 20160000243), d/b/a Kitty’s Corner 2, to add a Malt Off Sale license to the existing Gas Station and Cigarette/Tobacco licenses, located at 1530 Sherwood Avenue, be approved with the following condition:
1) Temporary window signs placed between the height of four (4) to seven (7) feet above grade shall not cover more than thirty (30) percent of this window space area, and cannot block views into the clerk or cashier station.
NOW, THEREFORE, BE IT RESOLVED that the Council of the City of Saint Paul hereby approves this license application with the aforementioned agreed-upon condition.
The Conditions Affidavit was signed on October 7, 2021 and submitted on January 4, 2022.
