Accepting deeds from Waterford Bay, LLC, and authorizing execution of an easement agreement for public access through the Waterford Bay development to the Mississippi River.

WHEREAS, on February 19, 2020 (RES PH 20-31) the City Council approved the Waterford Bay plat, attached hereto as Exhibit A ("WB Plat"), over property owned by SC OZ Waterford Bay LLC ("Developer") as part of the redevelopment of the former Island Station site located at 380 Randolph Avenue between the Sam Morgan Trail and the Mississippi River; and

WHEREAS, a condition of said resolution was that three of the four outlots dedicated in the WB Plat - Outlot A, Outlot C and Outlot D - be dedicated as city parkland; and

WHEREAS, Developer has agreed to convey said outlots to the City of Saint Paul (“City”) in two warranty deeds, attached hereto as Exhibit B and Exhibit C; and

WHEREAS, Developer is further prepared to grant an easement to the City, attached hereto as Exhibit D, to provide public access to a proposed parking lot for parkland users on property Developer is purchasing adjacent to Outlot C, and for additional access to the Mississippi River and to city-owned property to the west of Developer's property, all of which will greatly benefit the city park system; and

WHEREAS, on December 12, 2021 the Saint Paul Parks and Recreation Commission adopted Resolution # 21-23 recommending City Council acceptance of said warranty deeds and easement from Developer; now, therefore, be it

WHEREAS, the Saint Paul Parks and Recreation Commission was given an informational update on the acceptance of said warranty deeds and easement from Developer at its December 12, 2021 meeting but was unable to give a recommendation on the acceptance due to lack of quorum; now, therefore, be it

RESOLVED, that the City Council hereby:

1) Accepts said deeds from Developer to Outlots A, C and D, as provided in Exhibit B and Exhibit C;
