Approving adverse action against the Cigarette/Tobacco License held by W & T Market (“Licensee”) (License ID# 20080000233) at 604 Western Avenue.

WHEREAS, the Cigarette/Tobacco license held by W & T Market (“Licensee”) (License ID# 20080000233) for the premises located at 604 Western Avenue was the subject of a Notice of Violation dated September 9, 2021, stating that an Store clerk sold tobacco products to an underage person on August 3, 2021, in violation of Minn. Stat. § 609.685 and Saint Paul Legislative Code § 324.07 (g) and
WHEREAS, per Minn. Stat. § 461.12 Subd 2, the licensing office recommended a $300.00 Administrative penalty; and
WHEREAS, the licensee did not respond to the Notice of Violation to either pay the $300.00 Administrative penalty or request a public or administrative hearing; and
WHEREAS, the Notice of Violation stated that if the licensee failed to pay the $300.00 Administrative penalty or request a public or administrative hearing by September 23, 2021, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, W & T Market (“Licensee”) (License ID# 20080000233) are hereby ordered to pay a $300.00 Administrative penalty for the sale of tobacco products to an underage person on August 3, 2021.
Payment of such penalty shall be made within thirty (30) days of the date of the adoption of this resolution.
