Authorizing the Department of Parks and Recreation to enter into a Limited Use Permit (LUP) with and provide indemnification for the State of Minnesota Department of Transportation for continued use of an amenity zone within the right-of-way of Trunk Highway No. 149 for the High Bridge project.
Body
WHEREAS, the City of Saint Paul is a political subdivision, organized and existing under the laws of the State of Minnesota; and
WHEREAS, the City Council of the City of Saint Paul has approved the continued use of an amenity zone within the right-of way of Trunk Highway 149; and
WHEREAS, the State of Minnesota, Department of Transportation requires a LUP for utilization of said amenity zone; and
WHEREAS, the City of Saint Paul, Parks and Recreation Department, wishes to enter into the attached LUP required by the State of Minnesota, Department of Transportation; and
WHEREAS, the LUP will require that the City indemnify as well as hold the State of Minnesota, Department of Transportation harmless from all claims that may arise from the High Bridge trail project; now, therefore, be it
RESOLVED, that appropriate city authorities are hereby authorized to enter into the attached LUP with the State of Minnesota, Department of Transportation, which includes the promise of indemnification; and, be it
FURTHER RESOLVED, that the appropriate city authorities are authorized to execute the Limited Use Permit and any amendments to the Permit.
