WHEREAS, the Cigarette/Tobacco license held by Walgreens #06995 (“Licensee”) (License ID# 20020005083) for the premises located at 1788 Old Hudson Road was the subject of a Notice of Violation dated August 24, 2021, stating that an Store clerk sold tobacco products to an underage person on July 20, 2021, in violation of Minn. Stat. § 609.685 and Saint Paul Legislative Code § 324.07 (g) and
WHEREAS, On August 8, 2018, Walgreens #06995 (“Licensee”) (License ID# 20020005083) for the premises located at 1788 Old Hudson Road failed the Tobacco youth Compliance check and paid the $200 fine payment on August 31, 2018; and
WHEREAS, per Minn. Stat. § 461.12 Subd 2, the licensing office recommended a $600.00 Administrative penalty for a second violation at the same location within 36 months after the initial violation; and
WHEREAS, the licensee did not respond to the Notice of Violation to either pay the $600.00 Administrative penalty or request a public or administrative hearing; and
WHEREAS, the Notice of Violation stated that if the licensee failed to pay the $600.00 Administrative penalty or request a public or administrative hearing by September 7, 2021, that the matter would be placed on the consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, Walgreens #06995 (“Licensee”) (License ID# 20020005083) are hereby ordered to pay a $600.00 Administrative penalty for the sale of tobacco products to an underage person on July 20, 2021.
Payment of such penalty shall be made within thirty (30) days of the date of the adoption of this resolution.
