Resolution approving and authorizing the transfer and conveyance of HRA-owned land located at the Hamm’s Brewery site to the City of Saint Paul for park purposes and waiving the 45-day notice requirement, District 4, Ward 7
Body
WHEREAS, the Housing and Redevelopment Authority of the City of Saint Paul, Minnesota (“HRA”) is a public body corporate and politic established pursuant to the provisions of Minnesota Statutes, Section 469.001 et seq (the “HRA Act”); and
WHEREAS, the HRA has the power to engage in development or redevelopment activities under Chapter 469 of the Minnesota Statutes, Housing and Redevelopment Act (“Act”) and by authority of said Act engages in activities relating to: a) housing projects and development; b) removal and prevention of the spread of conditions of blight or deteriorations; c) bringing substandard buildings and improvements into compliance with public standards; d) disposition of land for private development; and e) improving the tax base and the financial stability of the community, and to engage in the aforementioned activities when these needs cannot be met through reliance solely upon private initiative and which can also be undertaken in targeted neighborhoods; and
WHEREAS, prior to 2003, the City of Saint Paul (“City”) improved a portion of privately-owned land to construct Swede Hollow Park; and
WHEREAS, in June 2003, by Resolution 03-6/25, the HRA purchased 8.79 acres of the former Hamm’s Brewery (Hamm’s Brewery Site) to preserve a portion of Swede Hollow Park for parkland (the Swede Hollow Park Parcel) and to acquire buildings at the site for redevelopment purposes; and
WHEREAS, in 2004, the City paid to the HRA $700,000 to acquire the Swede Hollow Park Parcel park purposes; and
WHEREAS, the Swede Hollow Park Parcel has not been conveyed from the HRA to the City; and
WHEREAS, the HRA and the City have agreed upon the boundaries of the Swede Hollow Park Parcel to be transferred for parkland, totaling approximately 2.2 acres; and
WHEREAS, alternative proposals are not being sought for the Swede Hollow Park Parcel, it is necessary to waive the 45-day notification requirement of the HRA Land Disposition Policy; and
WHEREAS, the HRA Board of Commissioners finds a public purpose for the actions being taken in this Resolution.
NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Housing and Redevelopment Authority of the City of Saint Paul, Minnesota, that:
1) The HRA Board hereby approves and authorizes the transfer and conveyance of the Swede Hollow Park Parcel to the City of Saint Paul for park purposes on the terms set forth in the staff report.
2) The HRA Chair/Commissioner is authorized and directed to execute the Quit Claim Deed conveying the Swede Hollow Park Parcel to the City of Saint Paul.
3) The HRA Executive Director, staff, and legal counsel for the HRA are directed and authorized to take all actions necessary to implement this Resolution and the HRA’s Executive Director is authorized to execute any other documents and instruments in connection therewith.
