Waiving the 45-day notice requirement to add an Entertainment (B) and Liquor Outdoor Service Area (Patio) to existing licenses for Randolph Craft LLC d/b/a A Side Public House (License ID #20210000331) at 754 Randolph Avenue.

WHEREAS, Randolph Craft LLC d/b/a A Side Public House (License ID #20210000331) applied for a Entertainment (B) and Liquor Outdoor Service Area (Patio) license for the premises located at 754 Randolph Avenue; and
WHEREAS, The Licensee currently holds a Liquor On Sale - 291 or more, Liquor On Sale - Sunday, and Malt Off Sale (Growler) licenses and
WHEREAS, licensee was required to seek support from a list of private residences, dwellings and apartment houses within a 300-foot radius of licensee's proposed Entertainment (B) and Liquor Outdoor Service Area (Patio) license at 754 Randolph Avenue that was provided by the Department of Safety and Inspection by signatures of approval on petitions; and
WHEREAS, records indicate the licensee had obtained twenty-two (24) out of fifty-eight (80) possible petition signatures for thirty-eight percent (30%) in support of adding a Entertainment (B) and Liquor Outdoor Service Area (Patio) license; and
WHEREAS, licensee was unable to obtain the 90% consent; and
WHEREAS, the licensee submitted a “good faith” email outlining his attempt to attain signatures required by the City of Saint Paul from residential property owners; and
WHEREAS, The Department of Safety and Inspections received a letter from West 7th/Fort Road Federation on July 29, 2021 in support of waiving the 45 day notice requirement and recommending the addition of an Entertainment (B) and Liquor Outdoor Service Area (Patio) to the existing licenses; and
WHEREAS, in response to the July 21, 2021 notification from the Department of Safety and Inspections regarding the license application, the City received no objections to add the Entertainment (B) and Liquor Outdoor Service Area (Patio) licenses; and
WHEREAS, the Council finds that the application is in order, the conditions recommended are reasonable and there are no grounds to deny waiving the 45 day notice requirement and adding the Entertainment (B) and Liquor Outdoor Service Area (Patio) licenses; now, therefore, be it,
RESOLVED, A Entertainment (B) and Liquor Outdoor Service Area (Patio) license is hereby approved for Randolph Craft LLC d/b/a A Side Public House (License ID #20210000331) for the premises located at 754 Randolph Avenue in Saint Paul with the following conditions:
CONDITIONS #1 - 2 PER ZONING CONDITIONAL USE PERMIT (CUP) #2018-098346
1. Approval of a parking variance and/or a shared parking agreement to address the parking requirements for Phase 2 of the development, a second-floor banquet hall, prior to Phase 2.
2. The business may operate only during the following hours: Monday - Thursday
Taproom/restaurant/banquet hall - 10:00 a.m. - 10:00 p.m., Coffee bar - 6:00 a.m. - 10:00 p.m., Patio - 10:00 a.m. - 9:00 p.m.; Friday - Saturday Taproom/restaurant/banquet hall - 10:00 a.m. - 12:00 a.m., Coffee bar - 6:00 a.m. - 12:00 a.m., Patio 10:00 a.m. - 10:00 p.m.; and Sunday Taproom/restaurant/banquet hall - 9:00 a.m. - 9:00 p.m., Coffee bar - 6:00 a.m. - 9:00 p.m., Patio 9:00 a.m. - 9:00 p.m.
ADDITIONAL LICENSE CONDITIONS #3 - 4:
3. No liquor sales, service, display and/or consumption is allowed outdoors unless prior written authorization and additional licensing is obtained from the Department of Safety and Inspections (DSI).
4. License acknowledges that no entertainment may be provided unless prior written authorization and additional licensing is obtained from DSI.
