Pertaining to a Private Water Main Agreement with the City of Maplewood and the property owners at 2142 and 2144 Arcade Street North.

WHEREAS, Stephanie and Paul Zollinger and Scott and Sarah Taylor have requested permission to install a private water main to serve the single-family homes at 2142 and 2144 Arcade Street North with domestic water service; and
WHEREAS, Stephanie and Paul Zollinger and Scott and Sarah Taylor propose to construct the private water main in accordance with Saint Paul Regional Water Services Standards and agree to accept full responsibility for the maintenance and repair of the private water main and hold the Board of Water Commissioners harmless from all claims that may arise from the existence or operation of the private water main; and
WHEREAS, the City of Maplewood is willing to dedicate an easement in the strip of land where the private water main is proposed to be installed; and
WHEREAS, staff has prepared a Private Water Main Agreement which sets forth those terms and conditions required by the city attorney’s office for the installation and operation of a private water main; now, therefore, be it
RESOLVED, that the Board of Water Commissioners of the City of Saint Paul hereby approves the Private Water Main Agreement with Stephanie and Paul Zollinger, Scott and Sarah Taylor, and the City of Maplewood to provide domestic water service and water supply to 2142 and 2144 Arcade Street North, in substantially the form submitted, and that the proper officers of the Board are hereby authorized and directed to execute said Private Water Main Agreement on behalf of the Board following approval of the assistant city attorney.
