Approving the application with conditions, per the Deputy Legislative Hearing Officer, for a Liquor On Sale - 100 seats or less, Liquor On Sale - Sunday, Entertainment (A) licenses for Sachoua & Houa LLC (License ID # 20210000176), d/b/a Smokin Ninjas located at 879 Rice Street.

 

Body

WHEREAS, Sachoua & Houa LLC (License ID # 20210000176), d/b/a Smokin Ninjas, located at 879 Rice Street, has applied for a Liquor On Sale - 100 seats or less, Liquor On Sale - Sunday, Entertainment (A) licenses; and

 

WHEREAS, objections to the Liquor On Sale - 100 seats or less, Liquor On Sale - Sunday, Entertainment (A) licenses were received within the notification period, and a hearing was held on May 10, 2021 and

 

WHEREAS, after conducting the hearing and considering the testimonies and evidence, the Deputy Legislative Hearing Officer recommends that the application for Sachoua & Houa LLC (License ID # 20210000176), d/b/a Smokin Ninjas, 879 Rice Street, be approved with the following conditions:

 

1.  The liquor service area is restricted to the first floor only.  No service, sale, and/or consumption of liquor is permitted on the second floor area.

2.  The licensee agrees to obtain prior written approval from the Department of Safety and Inspections (DSI) before any occupancy and/or use of the second floor is established. 

3.  The second floor area shall not be used for the storage of any type materials and/or items which may commonly be associated with the operation of a business.  This includes, but is not limited to tables, chairs, furniture, etc.

4.  The interior door between the first and second floor must remain locked/secured at all times the establishment is open to the public to prevent use of the second floor.

5.  The licensee shall maintain a lease for exclusive use of the parking spaces on the parcels of land with property identification numbers 252923410133, 252923410152, and 252923410151 at all times the business is in operation.

6.  Licensee will create a video surveillance camera and lighting placement plan (video surveillance plan) for the interior and exterior of the licensed premises.  Licensee will submit the video surveillance plan to the Saint Paul Police Department (SPPD) liaison with the Department of Safety and Inspection (DSI) for review and approval.  In accordance with the approved video surveillance plan, licensee will ensure that video surveillance camera system is in good working order, ensure it is recording 24 hours per day, ensure it can produce recorded surveillance video in a commonly used, up-to-date format, and ensure that accurate date and time of day are visible on all recorded video.  Licensee will retain surveillance video for a minimum of thirty (30) days.  If an incident is deemed serious by SPPD, licensee shall make surveillance video immediately available for viewing by SPPD.  If a copy of the surveillance video for a serious incident is requested by SPPD, Licensee shall have the technology, materials and staff available to immediately make the copy. In all other cases, licensee shall provide a copy of the surveillance video to the requestor within 48 hours.

 

THEREFORE, BE IT RESOLVED that the Council of the City of Saint Paul hereby approves this license application with the aforementioned agreed-upon conditions.

 

The Conditions Affidavit was signed on March 20, 2021.
