Accepting right-of-way easements from property owners abutting Edgcumbe Place in conjunction with the 2021 Griggs-Scheffer Phase II St. Paul Streets Project.
Body
WHEREAS, as part of the City's St. Paul Streets Program administered by the Department of Public Works, several streets within the Griggs-Scheffer Phase II project area will be reconstructed in 2021, including Edgcumbe Place; and
WHEREAS, seven residential properties abut Edgcumbe Place and property owners have requested a revision to Public Works' project plans to provide for reconstruction of the roadway outside of the platted right-of-way; and
WHEREAS, reconstruction of the roadway outside of the platted right-of-way will require new right-of way easements across portions of five of the seven properties; and
WHEREAS, Public Works, the City Attorney's Office and the Real Estate Section of the Office of Financial Services have worked cooperatively with property owners to identify the additional right-of-way needed and to prepare dedication of right-of-way easement documents ("ROW Easements") to facilitate receipt of the necessary right-of-way; and
WHEREAS, the property owners have executed ROW Easements, as provided in Exhibit A attached hereto, and now request the City's acceptance of said easements; and
WHEREAS, Public Works has reviewed and approved the ROW Easements; now, therefore, be it
RESOLVED, that the Mayor and Council of the City of Saint Paul do hereby accept the ROW Easements as set forth in Exhibit A attached hereto, and authorize the proper city officials to receive executed originals from the property owners and record same with the Ramsey County Recorder's Office.
