Title

Approving a Liquor Outdoor Service Area (Sidewalk) license with conditions to be added to existing licenses for Big River Pizza, Inc (License ID #20150000849) at 280 Sixth Street East.

Body

WHEREAS, Big River Pizza, Inc. (License ID #20150000849) applied for a Liquor Outdoor Service Area (Sidewalk) license for the premises located at 280 6th Street East in Saint Paul; and

 

WHEREAS, The Licensee currently holds a Liquor On Sale - 100 seats or less, Liquor On Sale - Sunday, Liquor- Outdoor Service Area (Patio) and Entertainment (A) licenses and

 

WHEREAS, the Department of Safety and Inspections received no objections to approval of the above-mentioned license; and

 

WHEREAS, the Council finds that the application is in order and there are no grounds for denial of the Liquor Outdoor Service Area (Patio) license; now, therefore, be it,

 

RESOLVED, a Liquor Outdoor Service Area (Sidewalk) license is hereby approved for Big River Pizza Inc (License ID #20150000849) for the premises located at 280 5th Street East in Saint Paul with the following conditions:

 

1.  Per City of Saint Paul Legislative Code 411.02, the definition of Entertainment A is, "Amplified or nonamplified music and/or singing by performers without limitation as to number, and group singing participated in by patrons of the establishment." (includes karaoke). Entertainment A license does not allow for patron and/or performance dances.

2.  Licensee agrees to take appropriate measures to ensure that the entertainment provided does not adversely affect the neighboring tenants (residential or commercial).

3.  No outdoor entertainment is allowed without prior written approval from DSI.

4.  Licensee agrees to limit the placement of items (e.g., table(s), chair(s), etc.) in the public right-of-way (e.g., sidewalk, street, etc.) to the area and items shown on the approved seating plan on file with the Department of Safety and Inspections (DSI) and Public Works.

5.  Each year prior to the placement of table(s) and/or chair(s) in the public right-of-way (i.e., sidewalk), the licensee agrees to obtain a new Obstruction Permit from the Department of Public Works.  Licensee agrees to maintain the sidewalk café in accordance with the conditions placed on an approved Obstruction Permit, acknowledges that an Obstruction Permit is effective on April 1 and expires on October 31 of each year, that items (e.g., table(s), chair(s), etc.) may not be placed in the public right-of-way before or after the effective/expiration dates, and that a failure to comply with this condition will result in adverse action being taken against all of their licenses.
