Authorizing execution of a lease between the HRA and New Cingular Wireless PCS, LLC, for telecommunications equipment at the Kellogg Ramp, District 17, Ward 2

Body

WHEREAS, the Housing and Redevelopment Authority of the City of Saint Paul (the “HRA” or “Lessor”) owns the Kellogg Municipal Parking Garage located at 129 Kellogg Boulevard, Saint Paul, Minnesota (“Kellogg Ramp”); and

 

WHEREAS, the HRA and New Cingular Wireless PCS, LLC (“Tenant”) entered into a Structure Lease Agreement, dated February 3, 2009, for Tenant’s telecommunications equipment at the Kellogg Ramp; and

 

WHEREAS, the term of the Structure Lease Agreement expired on June 21, 2018 and the lease has remained in effect as a month-to-month tenancy thereafter; and

 

WHEREAS, the HRA and Tenant seek to enter into a new Structure Lease Agreement on substantially the same terms as the previous lease agreement for an initial term of ten (10) years with two additional renewal terms each of five years (“Extension Term”), effective upon execution by Lessor and Tenant; and

 

WHEREAS, the monthly rent payment would be $600.00 and for each Extension Term, thereafter, will increase by fifteen percent (15%) over the rent paid during the previous lease term; and

 

NOW, THEREFORE, BE IT RESOLVED, that the HRA, pursuant to HRA Bylaws, Article II, Section 6(B), hereby authorizes the proper HRA officials to executive the by the proposed lease with and New Cingular Wireless PCS, LLC, for telecommunications equipment at the Kellogg Ramp consistent with this Resolution.
