Title

Authorizing the City of Saint Paul to enter into a joint powers agreement to operate a HUD Section 3 Compliance Program on behalf of the Counties of Dakota, Hennepin, Ramsey, Washington and Anoka, and the Public Housing Authority in Minneapolis.

Body

WHEREAS, pursuant to the provisions of Minnesota Statutes Section 471.59, two or more governmental units, by agreement entered into through action of their governing bodies, are authorized to enter into agreements to exercise jointly or cooperatively governmental powers common to each and to permit one governmental entity to perform services or functions for another governmental unit; and

WHEREAS, the counties of Dakota, Hennepin, Ramsey, Washington and Anoka, and the Public Housing Authority in Minneapolis are governmental units as defined under Minn. Stat. §471.59; and

WHEREAS, the City of Saint Paul and the Counties of Dakota, Hennepin, Ramsey, Washington and Anoka, and the Public Housing Authority in Minneapolis (hereinafter the Twin Cities Section 3 Collaborative) receive of funding from the United States Department of Housing and Urban Development (HUD) to foster development of housing and economic opportunities in urban areas; and

WHEREAS, as recipients of HUD funds, the City of Saint Paul and the Twin Cities Section 3 Collaborative must comply with various HUD requirements including compliance with Section 3 of the Housing and Urban Development Act of 1968; and

WHEREAS, the City of Saint Paul currently operates a HUD Section 3 compliance program that certifies low-income residents and businesses that reside in the City of Saint Paul and the surrounding metro area  in accordance with 12 U.S.C. § 1701u, 24 C.F.R. 135, subsequent regulations, and the City of Saint Paul HUD Section 3 Action Plan; and

WHEREAS, the Twin Cities Section 3 Collaborative wishes to combine efforts aimed at satisfying HUD Section 3 compliance  to increase efficiency and improve service to HUD Section 3 residents and businesses; and

WHEREAS, the combined structure will provide uniform certification, outreach, communication and education to Section 3 residents and businesses; and

WHEREAS, the parties intend to work together to develop new certification, education and outreach opportunities through this joint powers agreement; now, therefore, be it

RESOLVED, that the Saint Paul City Council, upon recommendation of the Mayor, authorizes the appropriate city officials  to enter into the attached joint powers agreement with the Counties of Dakota, Hennepin, Ramsey, Washington and Anoka, and the Public Housing Authority of Minneapolis whereby the City of Saint Paul will operate a HUD Section 3 Compliance Program in accordance with the Housing and Urban Development Act of 1968, as amended by Section 915 of the Housing and Community Development Act of 1992.
