Title

Approving amendments to the CERT Joint Powers Agreement.

 

Body

WHEREAS, pursuant to the provisions of Minnesota Statutes Section 471.59, two or more governmental units, by agreement entered into through action of their governing bodies, are authorized to enter into agreements to exercise jointly or cooperatively governmental powers common to each and to permit one governmental entity to perform services or functions for another governmental unit; and

 

WHEREAS, the counties of Hennepin and Ramsey, and the Cities of Minneapolis and Saint Paul are governmental units as defined under Minn. Stat. §471.59; and

 

WHEREAS, pursuant to City Council RES 18-1129, the Saint Paul City Council authorized the City of Saint Paul to enter into a Joint Powers Agreement creating the CERT  Collaborative comprised of the Hennepin County, Ramsey County, and the Cities of Minneapolis and of Saint Paul; and

 

WHEREAS, the CERT Collaborative oversees the CERT Program which certifies small business enterprises (SBEs), including minority-owned business enterprises (MBEs) and woman-owned business enterprises (WBEs) that qualify as SBEs; and

 

 

WHEREAS, each member of the Collaborative operates its own Business Assistance Program serving small business enterprises (“SBEs”), including, but not limited to, small minority-owned businesses (“MBEs”), and/or small women-owned businesses (“WBEs”); and

 

WHEREAS, the City of Saint Paul is the Lead Agency for the CERT Program; and

 

WHEREAS, the parties to the CERT Joint Powers Agreement would like to modify the effective date of the JPA from a three-year term with a subsequent yearly renewal, to a 12-month term with automatic renewal; and 

 

 

WHEREAS, the parties would like to formally acknowledge acceptance of electronic signatures in this and any future amendments to the Joint Powers Agreement; and now, therefore, be it

 

 

RESOLVED, that the City Council approves the proposed amendments to the attached CERT Joint Powers Agreement.
