Title
Approving the release of a Municipal Utility and Water Services Easement dedicated in the FORD plat and reflected in the WESTERN HIGHLAND BRIDGE plat.

Body
WHEREAS, as part of the infrastructure design work undertaken by the City of Saint Paul ("City") and the Ryan Companies ("Ryan") for the former Ford plant site in Saint Paul, a 20-foot-wide "Perpetual Easement for Municipal Utility and Water Services" was dedicated within Lot 1, Block 19 of the FORD plat (the "20-foot Easement"), as shown on Exhibit A attached hereto. The 20-foot Easement was intended for use by a public storm sewer pipe; and

WHEREAS, a portion of the FORD plat subsequently was subdivided in the WESTERN HIGHLAND BRIDGE plat so that Lot 1, Block 19 of the FORD plat now consists of Lots 1-5, Block 3 of the WESTERN HIGHLAND BRIDGE plat, as shown on Exhibit B attached hereto; and

WHEREAS, the infrastructure design process has progressed to the point that the 20-foot Easement is no longer necessary; and

WHEREAS, Ryan is now requesting a release of the 20-foot Easement by the City's Department of Public Works and the Board of Water Commissioners, which hold the easement rights within the 20-foot Easement area, as depicted and legally described in Exhibit C attached hereto; now, therefore, be it

RESOLVED, that with the Certificates of Intended Non-Use, filed voluntarily on behalf City's Department of Public Works and the Board of Water Commissioners ("Board"); the City, for itself and the Board, hereby waives all rights to the 20-foot Easement; and be it further

RESOLVED, that upon passage of this resolution and the City's receipt of a $300.00 administrative processing fee from Ryan, the proper city officials are hereby authorized and directed to record a copy of said resolution in the office of the Ramsey County Recorder and/or Registrar of Titles, and that the Office of Financial Services Real Estate Section shall maintain on file a copy of the Certificates of Intended Non-Use r...
