Waiving the 45-day notice requirement to issue a Liquor On Sale- 100 seats or less, Liquor On Sale- Sunday, Liquor- Outdoor Service Area (Sidewalk), and Gambling Location Licenses with conditions to Michael P. Mulrooney d/b/a Mike’s Tav On The Ave (License ID #20200002773) for the premises located at 472 Snelling Avenue South.

Body

WHEREAS, Michael P. Mulrooney d/b/a Mike’s Tav On The Ave (License ID #20200002773) applied for a Liquor On Sale- 100 seats or less, Liquor On Sale- Sunday, Liquor- Outdoor Service Area (Sidewalk), and Gambling Location Licenses for the premises located at 472 Snelling Avenue South; and  

WHEREAS, the licensee requested a waiver of the 45-day notification waiting period for approval of the above-mentioned licenses; and

WHEREAS, the Department of Safety and Inspections received a letter from the Macalester-Groveland Community Council on February 12, 2021 in support of a waiver of the 45-day notice requirement and approval of the Liquor On Sale- 100 seats or less, Liquor On Sale- Sunday, Liquor- Outdoor Service Area (Sidewalk), and Gambling Location Licenses; and 

WHEREAS, the Department of Safety and Inspections received no objections to the waiver of the 45-day notice requirement and approval of the Liquor On Sale- 100 seats or less, Liquor On Sale- Sunday, Liquor- Outdoor Service Area (Sidewalk), and Gambling Location Licenses; and

WHEREAS, pursuant to Saint Paul Legislative Code Section 310.05, imposition of conditions upon a license is adverse action; and

WHEREAS, Saint Paul Legislative Code Section 310.06(c) addresses the imposition of reasonable conditions and/or restrictions and authorizes the Council to impose conditions on Class N licenses with the consent of the license holder; and
