Approving adverse action against the Cigarette/Tobacco License held by Ammar Alfuraui d/b/a Twins Market & Meat (License ID #20160002240) at 1055 Fourth Street East.

WHEREAS, the Cigarette/Tobacco license held by Ammar Alfuraui d/b/a Twins Market & Meat (License ID #20160002240) at 1055 Fourth Street East in Saint Paul was the subject of a Notice of Violation and Request for Upward Departure sent November 2, 2020; and
WHEREAS, the Notice stated that during a follow up inspection of the licensed premises on October 8, 2020 an inspector from the Department of Safety and Inspections (DSI) observed and documented with photographs multiple flavored products violations; and
WHEREAS, the License has previously been the subject of Adverse Action. On September 10, 2020 the licensing office recommended imposition of a $1000.00 matrix penalty in a Notice of Violation for selling menthol cigarettes and flavored cigars documented by an DSI inspector on August 21, 2020, which licensee paid the penalty on September 25, 2020; and
WHEREAS, due to the number of the violations observed by the DSI inspector and failure to correct the violations documented on August 21, 2020, the City of Saint Paul Department of Safety and Inspections requested an upward departure in the penalty matrix to a $2,000.00 fine, a ten (10) day suspension of the Cigarette/Tobacco license; and
WHEREAS, on December 4, 2020, the licensee’s attorney responded to the Notice of Violation via Electronic delivery on behalf of the licensee to request a public hearing which was held on January 27, 2021; now therefore be it; and
RESOLVED, Ammar Alfuraui d/b/a Twins Market & Meat (License ID #20160002240) for the premises located at 1055 Fourth Street East in Saint Paul is hereby ordered to pay a matrix penalty of $2,000.00 for multiple flavored violations observed and documented by a DSI Inspector during a inspection of the licensed premises on October 8, 2020.
FINALLY RESOLVED, the Cigarette/Tobacco license held by Ammar Alfuraui d/b/a Twins Market & Meat is hereby suspended for a period of ten (10) days.
Payment of such penalties shall be made within thirty (30) days of the date of the adoption of this resolution. Failure to pay the penalties within thirty (30) days will result in immediate suspension of the license.
