Approving adverse action against the Cigarette/Tobacco License held by Mini Pac (License ID #20180004316) at 1184 Maryland Avenue East.
Body
WHEREAS, the Cigarette/Tobacco license held by Mini Pac (License ID #20180004316) for the premises located at 1184 Maryland Avenue East in Saint Paul was the subject of a Notice of Violation sent November 30, 2020; and
WHEREAS, the Notice stated that during a complaint-based inspection on October 8, 2020, a DSI Inspector observed and documented with photographs ‘Backwoods Cigars’ Russian Cream, Honey Bourbon and Honey Berry in violation of Saint Paul Legislative Code § 324.07 (e); and
WHEREAS, per Saint Paul Legislative Code § 310.05 (m) (2), the licensing office recommended a $500.00 matrix penalty; and
WHEREAS, the licensee did not respond to the Notice of Violation to either pay the $500.00 matrix penalty or request a public or administrative hearing; and
WHEREAS, the Notice of Violation stated that if the licensee failed to pay the $500.00 matrix penalty or request a public or administrative hearing by December 14, 2020, that the matter would be placed on the next available consent agenda to impose the recommended penalty; now, therefore, be it
RESOLVED, Mini Pac (License ID #20180004316) for the premises located at 1184 Maryland Avenue East is hereby ordered to pay a $500.00 matrix penalty for the ‘Backwoods Cigars’ Russian Cream, Honey Bourbon and Honey Berry.
Payment of such penalty shall be made within thirty (30) days of the date of the adoption of this resolution.
