Title

Authorizing the City to execute a third amendment to a conservation easement held by the State of Minnesota within the Bruce Vento Nature Sanctuary in order to perform geo-technical investigations to determine the feasibility of constructing a proposed Wakan Tipi Center within the sanctuary property.

 

Body

WHEREAS, under an executed development agreement between the City of Saint Paul ("City") and the Lower Phalen Creek Project ("LPCP"), the City's Department of Parks and Recreation is cooperating with LPCP on the design and construction of a proposed Wakan Tip Center within the City-owned Bruce Vento Nature Sanctuary ("BVNS") property; and

 

WHEREAS, LPCP would like to conduct soil analyses, testing, surveying, boring and other geo-technical investigations in connection with the feasibility of constructing the Wakan Tipi Center; and

 

WHEREAS, said geo-technical activities would be performed within the area of the BVNS subject to an easement granted to the State of Minnesota in 2002 and amended in 2007 and 2015 (the "Conservation Easement"), thereby requiring a third amendment to the Conservation Easement; now, therefore, be it

 

RESOLVED, that the City Council hereby authorizes the appropriate city officials to execute a "Third Amendment to Conservation Easement" with the State of Minnesota in substantially the form attached hereto as Exhibit A, and to permit the LPCP, in cooperation with the City's Department of Parks and Recreation, to pursue said geo-technical activities within the BVNS.
