Making finding on the appealed nuisance abatement ordered for 1610 UPPER AFTON ROAD in Council File RLH CO 20-10.

WHEREAS, the City Council adopted RLH CO 20-10 on August 12, 2020 which granted an extension to grant to August 21, 2020 for compliance with the Summary Abatement Order and October 1, 2020 for the Correction Notice pertaining to the vehicles and driveway; and
WHEREAS, the Legislative Hearing Officer reviewed this case on October 6, 2020 to determine if the owner and/or responsible party abated the nuisance conditions related to the Summary Abatement Order and found these conditions were not abated; and
WHEREAS, Department of Safety and Inspections staff issued a second Summary Abatement Order for the same items "in error" which was the extension requested by the owner and Legislative Hearing Officer granted an extension to November 2, 2020 for compliance;
WHEREAS, the Legislative Hearing Officer reviewed this case on November 10, 2020 to determine if the owner and/or responsible party abated the nuisance conditions related to the 2nd Summary abatement and found these conditions were not abated; now, therefore, be it
RESOLVED, that the Saint Paul City Council adopts the finding of the legislative hearing officer that the nuisance condition is not abated and therefore authorizes the Department of Safety and Inspections to proceed with this nuisance abatement.
