Pertaining to a Second Amended Lease Agreement with the City of Saint Paul for the extension of its Police Department’s lease for the City’s canine training facility.

WHEREAS, at its January 18, 1978 meeting, the Board of Water Commissioners did adopt Resolution No. 2742 which authorized a Lease Agreement between the Board and the City of Saint Paul allowing the City to carry out a police canine team training and exercise program on certain Board-owned property at the McCarron’s Treatment Plant (the “Premises”); and
WHEREAS, said lease agreement was set to expire June 27, 1998; and
WHEREAS, at its January 9, 1995 meeting, the Board of Water Commissioners did adopt Resolution No. 4349 which authorized an Amended Lease Agreement which extended the term of the 1978 Lease Agreement for an additional thirty (30) years to June 26, 2028; and
WHEREAS, the City wishes to make long-term improvements to the facility, and the useful lives of such improvements are expected to last through the year 2053; and
WHEREAS, the Chief of Police of the City’s Police Department has formally requested, in writing, that the current lease be amended to expire in the year 2053, concurrent with the expected life of the planned long-term improvements and the Board is willing to extend the lease as requested; and
WHEREAS, the city attorney’s office has reviewed and approved said Second Amended Lease Agreement as to form; now, therefore, be it
RESOLVED, that the Board of Water Commissioners of the City of Saint Paul does hereby approve this Second Amended Lease Agreement to the Amended Lease Agreement dated January 9, 1995 so as to extend the term thereof to June 27, 2053, and the proper officers of the Board are hereby authorized and directed to execute the Second Amended Lease Agreement on behalf of the Board.
