Approving the release of a portion of the easement rights conveyed to the City of Saint Paul in vacated Greenbrier Street, north of vacated Bush Avenue.

WHEREAS, as a condition to vacate portions of Bush Avenue and Greenbrier Street lying north and east of Payne Avenue and Minnehaha Avenue East, as approved in City Council File No. 210767 ("Vacation Resolution") attached hereto as Exhibit A, then-property owner Theo. Hamm Brewing Company conveyed easements to the City of Saint Paul ("City") for Fire Department access and public sewer conduit and water main access, as recorded in Ramsey County Document Number 1588554 ("Easement") attached hereto as Exhibit B; and
WHEREAS, Everest, LLC ("Owner") owns or has interest in the property located at 707 Minnehaha Avenue East (the "Property"), which encompasses the above-mentioned vacated streets; and
WHEREAS, Owner and/or its assigns plan to improve the Property and have requested the release of the easements rights conveyed to the City within vacated Greenbrier Street ("Easement Release Area"), as described in Exhibit C attached hereto; now, therefore, be it
RESOLVED, that with the Certificates of Intended Non-Use, filed voluntarily on behalf of the City's Department of Public Works, St. Paul Regional Water Services and the Saint Paul Fire Department, the City, for itself and on behalf of said public utilities, hereby waives, releases and terminates the easement rights conveyed to the City in the Easement within the Easement Release Area; and be it further
RESOLVED, that upon passage of this resolution and the City's receipt of a $300.00 administrative processing fee, the proper city officials are hereby authorized and directed to record a copy of this resolution in the office of the Ramsey County Recorder and/or Registrar of Titles, and that the Office of Financial Services Real Estate Section shall maintain on file a copy of the Certificates of Intended Non-Use referenced in this resolution; and b...
